Shadrack Carter v. Nancy Kilburn, Pulaski, 1819

SHADRACK CARTER v. NANCY KILBURN.

COURT OF APPEALS OF KENTUCKY

8 Ky. 463; 1819 Ky. LEXIS 38; 1 A.K. Marsh. 463

April 17, 1819, Decided

PRIOR HISTORY:  [**1]  Writ of Error to reverse an Order of the Pulaski Circuit Court.

DISPOSITION: Judgment reversed, with cost, cause remanded, and proceedings dismissed.

COUNSEL: Talbot for plaintiff.

JUDGES: Judge OWSLEY.

OPINION BY: OWSLEY

OPINION
[*463]  Judge OWSLEY delivered the opinion of the court.

We are of opinion, that upon its being shown that Carter resided in the county of Lincoln, the court of Pulaski ought to have dismissed the proceedings had upon a warrant issued from a justice of Pulaski against him, under the act regulating proceedings in cases of bastardy.

The judgment must be reversed, with cost, the cause remanded, and the proceedings dismissed.
